Union Issues


1. Disability Bill Update
On Monday June 6th, the Mayor's office announced agreements with UFA along with Corrections & Sanitation, restoring three-quarter disability for current Tier 3/6 members, and future hires. On Wednesday, June 8th, the home rule was passed by NYC Council. On Tuesday, June 14th, it passed through the NYS Senate by a 61-0 vote & on Thursday, June 15th, it was passed in the Assembly, 113-0. The next step is for the Bill to be called up by Governor's Andrew Cuomo's office and signed into law. Once a date for the signing is determined, we will announce it to our membership. The UFA would like to thank the Bill's sponsor Senator Marty Golden, along with Mayor de Blasio & the City Council. The Bill is #S.8015 (Golden), #A.10567 (Abbate).

  • All Existing presumptions under Tier 2 will be restored.
  • The less expensive Tier 2 Cost of Living Adjustment will be restored.
  • The Final Average Salary will be based on five years, and no single year can exceed the prior four years by more than 10 percent, as is the case under current law.
  • The social security offset will be eliminated.
  • Tier 3/6 Firefighters will pay a payroll contribution of 2 percent of salary for this enhanced benefit, for a total of 5% contribution, which can rise as high as 3 percent of salary based on usage and other actuarial factors after a three year lookback.

Once the Bill is signed into Law, all current Tier 3/6 members will have 120 days to opt into the new enhanced plan. Information will be posted on the Department orders & intranet. The forms will be posted on the FDNY intranet, along with the UFA website.

2. Fire Marshal Representative Nominated & Re-elected
Congratulations to UFA Fire Marshal Representative, Steve Tagliani (BFI) who has been re-elected to a three-year term in office. Fire Marshal Tagliani ran unopposed, and on June 9th at the UFA member meeting, he was both nominated and re-elected. The new term of office takes effect August 1, 2016.

3. PBA of the City of New York v. The City of New York and the New York City Office of Labor Relations
On May 17th, the PBA filed Summons & Complaint and an Order to Show Cause for a TRO & Preliminary Injunction vs the City & OLR concerning the changes to Healthcare Co-pays effective July 1st. On June 22nd, the appellate court granted a TRO to the PBA, with a return date of July 5th. For the time being, this will not affect the upcoming changes, we will keep the membership updated as this issue plays out in court.

4. Military Buyback Bill Signed into Law
NYS Governor Andrew Cuomo signed the Military Buyback Bill into Law. The bill, S7160, will allow all public employees to obtain up to three years additional retirement credit for their military service, with no restrictions based on where or when they served. For the first time women will also be eligible. It is Chapter 41 of the Laws of 2016. Members can buy back up to 3 years of service time, however they must be vested, (5 years in the FDNY). Applications are available on the UFA website (under forms) and on the FDNY intranet, (see dept. order #40). UFA VP Jim Slevin updated the membership at the June meeting.

5. NYS Civil Service Commission approves new FDNY Cadet Program
On Wednesday, June 16th in Albany, the New York State Civil Service Commission approved a resolution to allow the FDNY to begin the implementation of a new Fire Cadet program. UFA president Steve Cassidy and Uniformed EMT's, Paramedics Local 2507 president Izzy Miranda both testified strongly in opposition to this program. This was also supported by letters in opposition from the president of the New York State AFL-CIO Mario Cilento and Vinny Alvarez President of the New York City Central Labor Council, along with Harry Nespoli, chairman of the New York City Municipal Labor Committee and the Honorable Daneek Miller Chairman of the New York City Council, Committee on Civil Service and Labor. Despite this overwhelming and united opposition, the state civil service commission approved the resolution allowing for the program's creation. We will update the membership with any additional information as we receive it.

On June28th, NYS Professional Firefighters held elections at the annual convention which was held in Binghamton NY. Sam Fresina of Albany NY was elected to replace Mike McManus as President, James McGowan (UFOA) was elected as Secretary-Treasurer and Dave Halloran (Binghamton FD) was elected as executive VP. We congratulate the new officers and wish them much success moving forward.

7. SBF Benefits Increased
The Executive Board is pleased to announce an SBF benefit increase to both active & retired members' Optical plans, along with a hearing aid benefit increase. A mailing went out this week to all members, and will be posted on the UFA website. The new benefit begins July 1, 2016.

8. Volunteering in Paid FD? UFA & IAFF Constitution Violation
Article XVI, Section 3 of the UFA Constitution, as well as the IAFF Constitution, prohibit volunteering as a Firefighter in a paid fire department. Members who do this jeopardize other professional firefighters' careers and livelihoods. If the UFA receives a report of a member that is in violation of these provisions, as required, proceedings will begin to address the allegation. If confirmed, the offending member may be declared "a member not in good standing" as well as have his or her name listed in the UFA FireLines publication, which is circulated to all 20,000 active and retired members.

Garden City Update: Layoffs have been averted for the time being. Port Chester Update: The fight continues in Port Chester, after the city council voted to terminate all paid Firefighters. 9. Update Your Address, Email, Phone #s with the UFA
Members and Delegates wishing to receive important information or notifications from the UFA should insure that their residence addresses, email addresses, home and cell phone numbers on file with the UFA are updated and accurate. In order to do this, you must prepare and sign a 'SBF Change of Address Form' and mail to the UFA, Attn: SBF. Forms can be obtained from your Delegate, who can assist you, or you can call the UFA SBF at 212-683-4723, or visit the Forms Section of the UFA web site. Additionally, members wishing to receive e-mails from the UFA should add the UFA e-mail address, UFA@ufanyc.org, to their contacts. Members are reminded to also notify the Fire Department of your changes, especially your mailing address..

10. Memorial Golf Outing
The Johnny Mac Foundation will be hosting the 6th Annual Golf Outing on Thursday, July 14th at the Dyker Beach Golf Club in Brooklyn. The outing is in memory of FF John McNamara, E-234, who died of 9/11 related cancer in August 2009.
