This "non-decision" was mediated by A] Viani, with helpful input by Labor Commissioner Jim Hanley While not considered a total win, most important points were dealt with in a satisfactory manner and no precedent was created. This dispute can not be referenced as evidence in any future legal or administrative action The truck delegate is being returned to Ladder 129. The fourteen lifted members will have CD-30's filled out for the company they are assigned to, which will be processed in the normal manner to eliminate any detnimental paper trail. The two rotating firefighters who were abruptly sent back to 273/ 121) will be returned to complete their rotation experiance ence as soon as possible. Five members have been g iven the opportunity to file another CD-30, where upon they will get one of three choices requested (from an operational list of units s with roster openings). The Joint cooperation of the UFOA executive board, especially President Pete Gorman, was extraordinary and beyond the call of duty. Back To Top CONFUSION OVER TWO IN/TWO OUT OSHA STANDARD The Department has made an attempt at complying with the OSHA Two In/Two Out regulations with the recently issued AUC 329. This in no way, shape or form complies with the law- It was drafted back in November and sent to both unions for review and comment. The following excerpt is from a joint UFA/UFOA letterhead response to the FDNY, dated 11/ 18/99; Last June 14th, we sent you a letter outlining some clear violations to the " 2 in 2 out " regulations. We never received any response to our letter. Again we quote OSHA regulation 129 CFR 1910.134], WHICH STATES "Fire Departments must develop and implement standard operating procedures addressing fire ground operations and 2 in 2 out" procedures to demonstrate compliance. Fire Department training programs must ensure that the firefighters understand and implement appropriate "2 in 2 out " procedures. A UC 329 clearly contradicts most if not all written Department policy, and does not properly, address the issue of "2 in 2 out.
